
Does a Seller Have to Accept a Full-Price Offer?
There’s a common misconception in real estate: that if a seller gets a full-price offer, they must accept it.
That’s absolutely not the case.
Sellers can decline any offer
When a home is listed with a REALTOR®, the seller can receive an offer:
- At asking price
- Above asking price
- With no conditions whatsoever
…and still decline it. A seller has no obligation to sell just because their home is listed and an offer meets the list price.
Why would a seller say no?
- The home was priced low intentionally to attract multiple offers, and the seller hoped for more
- The closing date doesn’t work
- They’ve changed their mind about selling
- They’re expecting other offers
What about private sales?
Private sales, where a home is sold without a REALTOR®, can be a different situation. The specific terms and any agreements made matter. When a home is listed with a REALTOR®, the seller has full control over which offer, if any, to accept.
What buyers should do
- Don’t assume list price means a guaranteed purchase price
- Ask your agent how the home was priced and why
- Be prepared for a counter-offer or competition
- Know your limit before you make an offer
